Damian Cleary is a partner in the London office of Foran Glennon (UK) LLP where he is a¬†member of the Firm’s Insurance and Reinsurance group. He has established an excellent¬†reputation for handling insurance and reinsurance matters for the Lloyd’s and London¬†companies markets.
Mr. Cleary has particular experience and has also developed a significant reputation on¬†issues surrounding Business Interruption (BI) insurance including acting for insurers in the¬†Orient Express Hotels case. More recently, he has been advising the London market on¬†Follow Settlements issues as a result of his instruction by excess reinsurers in relation to¬†the Thai floods in 2011.
His work also includes advising insurers and reinsurers in non-marine disputes in many worldwide¬†jurisdictions, with a particular emphasis on risks concerning accident and health, property/BI, onshore¬†energy and engineering, D&O (Mr. Cleary acted for the D&O insurers of the former directors of Equitable Life¬†in relation to the ¬£3 billion pound claim against them) and After the Event (ATE)/legal expenses delegated¬†authority.
Recognised by Chambers UK for Insurance UK-wide, he also advises on bespoke policy clauses and wordingsand related risk management, as well as on UK matters arising out of global or national regulatoryinvestigations, including the U.S. Office of Foreign Asset Control (OFAC), the DTI and the FCA, includingresponses to subpoenas for documents and other evidence. In addition to his work in the insurance/reinsurance markets, he also advises on commercial litigation and arbitration, most recently on commodities,natural resources and onshore oil & gas disputes, often with a Russian emphasis (for which he has been”particularly recommended” in Legal 500).
