Thomas S. Gozdziak
A partner in the firm, Thomas S. Gozdziak concentrates his practice in first-party property insurance disputes.¬† His experience includes all-risk, equipment breakdown, builder‚Äôs risk and inland marine policies.¬† His practice has involved representing admitted carriers, surplus lines carriers and captive insurers, at primary and excess layers, and representing reinsurers.¬† Mr. Gozdziak advises and represents clients regarding bad faith claims and has experience using reverse bad faith as a tool in defending insurers.¬† He has presented to various insurance clients on first-party property and bad faith issues, including claims handling practices.
Mr. Gozdziak has represented clients in matters pending in state and federal courts throughout the country.¬† Among Mr. Gozdziak‚Äôs successes is his role as lead litigation counsel in a $30 million first-party coverage dispute involving damaged material handling equipment at a bauxite mining facility in Guinea, West Africa.¬† The disputed issues involved repair v. replacement valuation and complex business interruption loss measurement issues, and the case included bad faith and reverse bad faith allegations.¬† After a 3-week federal trial, the jury awarded the insured only $270,084 (Compagnie des Bauxite de Guinee v. Three Rivers Insurance Company, U.S. District Court for the Western District of Pennsylvania).¬† Mr. Gozdziak has also been successful in achieving favorable results for his clients through the use of alternative dispute resolution processes.¬† He has also obtained subrogation recoveries from responsible parties and contribution recoveries from other insurers.
Mr. Gozdziak earned his B.S. degree in Accounting from Bradley University in 1990 and his J.D. degree from The John Marshall Law School in 1995.
Mr. Gozdziak is authorized to practice law in Illinois and in the U.S. District Courts for the Northern and Central Districts of Illinois and the Eastern District of Michigan.¬† He is a member of the Trial Bar of the U.S. District Court for the Northern District of Illinois. He has also been admitted pro hac vice in numerous jurisdictions throughout the United States.
Mr. Gozdziak is a member of the American Bar Association, the Claims and Litigation Management Alliance, the Coalition Against Insurance Fraud, the National Society of Professional Insurance Investigators, the Property & Liability Resource Bureau, and the Western Loss Association.
