Partner Douglas Lange negotiated a significant pre-trial settlement for a food processing plant in a property damage subrogation claim against an international designer and manufacturer of electrical components.
The case involved an alleged failure of an electrical component in the main service panel at the plant. The component was installed during an expansion of the electrical room several years prior to the failure of the device. The explosive event caused significant property damage and caused smoke and soot to permeate the facility resulting in the contamination and condemnation of tens of thousands of tons of produce.
Doug successfully pursued the plaintiff’s claims despite the age of the device, passage of time from its installation, design and manufacturing discrepancies and contractual issues, and obtained a significant pre-trial settlement.
