Vincent Passarelli recently obtained summary judgment for a New York county water authority contesting recovery of damages for allegedly sustained personal injuries.
The Plaintiff in the case alleged that he tripped and fell over a raised water valve box on a New York neighborhood sidewalk. The client, however, did not own or maintain the sidewalk where the box was located and was able to provide evidence they had no relation to the box. The record submitted referenced a contractor in the 1960s hired by the owner or developer of the adjoining property, showing no duty to maintain the alleged accident area.
Vincent took the depositions, drafted the motion and was successful as the Court dismissed the Plaintiff’s complaint against the insured, stating that no triable issue of fact was demonstrated.
