Our approach to commercial disputes is two-fold. First, we assist management in identifying areas that can create potential risk exposures to the organization. Based upon our exposures analysis, we then collaborate with the organization’s staff to design and implement risk control strategies to manage the risk. Second, when our client is presented with an actual claim or dispute, we assist in evaluating the claim or dispute. We then develop one or more strategies for resolving the dispute cost effectively, whether through trial, arbitration, mediation, or other alternative dispute resolution techniques.

Similarly, we understand that not all business disputes need give rise to adversarial confrontation. Sometimes conflict can be addressed through meaningful negotiation and compromise. Whether before or after a lawsuit is filed, we have the expertise to guide the parties’ negotiation and to structure the final terms of the resolution to maximize our client’s results.
