After a five-week jury trial in the Circuit Court of Cook County Illinois of downtown Chicago, Foran Glennon shareholder Matthew Ponzi and partner Christopher Snow achieved a defense verdict in a first-party coverage dispute between the firm’s insurance client and a food products supplier involving $35.6 million in total damages claimed.
The case arose out of a 2017 ammonia leak and explosion at the food product supplier’s meat production facility in Elk Grove Village, Illinois. During an 18-month long claim investigation, disputes arose over all aspects of the claim from property damage to business interruption and extra expense. Our client alleged, and ultimately proved at trial, that the Plaintiff misrepresented and intentionally concealed material facts on its extra expense claim which resulted in an overpayment in excess of $1 million. The jury awarded recoupment of the overpayment in damages to our client on its counterclaim.
