Founding partner Matthew Ponzi successfully represented Travelers Indemnity Co. against two wind and hailstorm damage claims resulting in an estimated $2.6 million cost from an Indiana condominium association.
A condo association in Indiana alleged their buildings sustained significant damage during storms in June 2016 and April 2017 but waited more than a year to file the first claim and eleven months to file the second.
The U.S. District Judge on the case ruled that Travelers could not investigate whether the damages were caused by the storms in question, other weather conditions or even if the damages occurred during the policy period because the claims were filed “unreasonably late.”
