Foran Glennon shareholder Thomas Orlando obtained an appellate victory on behalf of his independent claims adjuster client, with the Illinois Appellate Court affirming the dismissal of a negligence claim brought by a slip-and-fall plaintiff. The court held that the independent adjuster, that had been retained by the property owner’s liability insurer to investigate the claim, owed no legal duty to the injured third party and had no contractual or statutory obligation that could support a cause of action.
The ruling reinforces Illinois law that without a contractual or other legally recognized relationship, an insurance adjuster does not owe a duty to third-party claimants.
