Foran Glennon shareholder Douglas Palandech was recently featured in three episodes of a negotiation series produced by the Willis Architects and Engineers (A&E) podcast Talk to Me About A&E.
During his time on the podcast, Doug and host Dan Buelow, the managing director of Willis A&E, discussed a variety of topics surrounding risk management and trends currently impacting architects and engineers, including:
- Episode one: “Negotiating Contracts: Critical Basics” discusses tips to use contract formation as a route to establish client expectations and mitigate the risk of costly claims and client disputes.
- Episode two: “Negotiating Contracts: Deal Makers” analyzes contract clauses that firms should include in each agreement they sign, as well as advises firms to think carefully about whether a project is worth accepting.
- Episode three: “Negotiating Contracts: Dealbreakers” identifies client-drafted clauses that are “dealbreakers” due to their burdensome nature and advises firms to insist on deleting or seriously modifying these clauses to avoid significant and potentially uninsurable risk.
