Doug Palandech shared insights on the risks associated with design professionals’ marketing tools and activities at the Willis Architects & Engineers 2019 Legal Roundtable at Willis Tower.
Doug, joined by Susan Neiswender Black of H.W. Lochner, Inc., addressed how architects and engineers may be subject to breach of contract, misrepresentation or warranty claims if they fail to provide a promised certain level of care or inaccurately market themselves.
The two shared ways to avoid or mitigate these risks by incorporating an integration clause, utilizing a generally accepted standard of care clause in design contracts and clearly disclaiming implied warranties.
