Matthew Ponzi and John Eggum obtained a judgment dismissing a COVID-19 lawsuit alleging a purported “chemical alteration” of property, providing further guidance for insurers faced with COVID-19 claims.
After an appraisal award and four years of Plaintiff’s efforts to invalidate that award, the U.S. District Court for the Northern District of Indiana awarded summary judgment to Mike Foran and John Eggum’s insurer client in a breach of contract and bad faith lawsuit stemming from a fire at a hotel in northwest Indiana. The Dispute, which included claims for punitive damages and more than $5 million in contract damages, was heavily contested, but the Court agreed with Shareholders Foran and Eggum that the hotel owner could not prove there was a triable issue of fact, after considering the several thousand-page record.
